Defending a Director Accused of Breaching Duties
Background
Our client, a director of a limited company in liquidation, was accused of breaching their director’s duties, with the insolvency practitioner claiming significant sums were owed to the company. The director strongly disputed this, asserting that all sums had been repaid. With court proceedings initiated, the client required legal representation to defend their position and navigate the complex accounting issues at the heart of the case.
Approach
With our expertise in director’s duties, company operations, and insolvency law, we litigated aggressively but fairly, identifying weaknesses in the claimant’s case. Through thorough correspondence with opposing solicitors, we guided the client through every stage of the proceedings, managing expectations and keeping the client informed throughout the process.
Outcome
Our strategy successfully exposed the gaps in the claimant’s case. We negotiated a favourable settlement at around one-third of the original claim, including costs, structured as an affordable payment plan. The resolution allowed the client to move on from the proceedings without further financial risk or stress.
