Successfully Challenging an HMRC Statutory Demand

"Our client, a partner in a successful partnership, was served with a statutory demand by HMRC for an alleged outstanding tax debt. Facing the threat of bankruptcy, the client required immediate legal intervention to protect their financial position and reputation."

Background

Our client, a partner in a successful partnership, was served with a statutory demand by HMRC for an alleged outstanding tax debt. Facing the threat of bankruptcy, the client required immediate legal intervention to protect their financial position and reputation.

Approach

We applied our deep understanding of statutory demands and bankruptcy petitions to analyse HMRC’s claim in detail. After conducting a full financial review, we identified multiple grounds on which to dispute the alleged debt. Despite our efforts to engage with HMRC and explain the inaccuracies, they refused to withdraw the demand and persisted with bankruptcy threats. We swiftly filed an application to set aside the statutory demand and represented the client at the court hearing.

Outcome

The court found in our client’s favour, setting aside the statutory demand and ordering HMRC to pay the client’s legal costs. This decisive outcome not only protected the client from potential bankruptcy but also provided peace of mind and security for their financial future.
