Background

Our client, a hotel owner in the Lake District, was locked in a long-running dispute with a neighbouring hotel over access rights. The neighbouring hotel had repeatedly obstructed the shared entrance, preventing the client and their guests from using the original access route. While the client had created a secondary entry, they wanted legal confirmation that they had the right to use the original access route.

 

Approach

We were instructed to apply to the Land Registry to amend the client’s title, ensuring it reflected their right of way. This required detailed analysis of historic title documents spanning over 100 years and expertise in both land law and the Lands Tribunal process. Understanding the Civil Procedure Rules, we gathered witness evidence, disclosed documents, and assessed the risks involved. Given the potential cost implications of losing, we ensured the client had a strong case before proceeding.

 

Outcome

Before the Lands Tribunal could rule, the neighbouring hotel conceded on highly favourable terms. The client’s legal right of way is now officially recorded, securing access for both them and their guests.
