Before the introduction of Lasting Powers of Attorney (LPAs) in October 2007, individuals in England and Wales could appoint someone to manage their financial affairs using an Enduring Power of Attorney (EPA). While EPAs can no longer be created, many remain valid and in use today.

What Is an Enduring Power of Attorney?

An Enduring Power of Attorney is a legal document that was used to appoint one or more attorneys to manage a person’s property and financial affairs. It differs from a Lasting Power of Attorney in several key respects:

  • EPAs cover only property and financial matters; they do not extend to health and welfare decisions.
  • EPAs created before 1 October 2007 remain valid but cannot be altered or reissued.
  • They must be registered with the Office of the Public Guardian (OPG) once the donor loses or begins to lose mental capacity.

It is a common misconception that an EPA gives attorneys immediate powers at all times. In fact, once the donor starts to lose capacity, the attorney must register the document before continuing to act.
